1. Acceptance and eligibility
These Terms of Service (“Terms”) are a binding agreement between you and F1v3 Group LLC (“Stax Budget,” “we,” “us,” or “our”) covering the Stax Budget apps, this website, account services, support and related services (together, the “Service”). By creating an account, buying a subscription, or using the Service, you agree to these Terms and acknowledge the Privacy Policy. If you do not agree, do not use the Service.
You must be at least 13 years old. If you are under the age of majority where you live, a parent or guardian must permit your use and agree to these Terms for you.
2. What Stax Budget provides
Stax Budget helps you plan bills around your pay periods, record payments, track what has cleared, see how much income is still needed, view reports, and share budgets with people you invite. Budget content is encrypted on your device before it syncs; our servers store encrypted records and the metadata needed to sync and share them.
Stax Budget is not a bank, a financial adviser, a tax adviser, or a payment service. It does not connect to your financial accounts, does not pay bills for you, and does not know your real balances. Totals, coverage, make-up amounts, make-up hours and reports are calculated from the figures you enter. Check important numbers against your bank and your bills before you rely on them.
3. Your content
“Your Content” means the bills, payments, income, categories, notes and other information you or people you share with put into the Service. You keep your rights in Your Content. You authorize us to store, copy, sync, back up, share with the people you choose, and delete its encrypted form only as needed to provide and protect the Service.
You are responsible for having the right to store the information you enter, including information about other people, and for the people you invite to a shared budget. Anyone you share a budget with can see it, and may keep what they saw or copied even after you remove them.
4. Your account and security
You are responsible for activity on your account and devices, except where caused by our breach of these Terms. You agree to:
- use a strong password you don’t use anywhere else;
- keep your password, recovery phrase and sign-in codes private, and store your recovery phrase somewhere safe and separate from your devices;
- keep your devices locked, updated and free of malware;
- review who has access to your shared budgets and remove people who no longer need it; and
- tell us promptly at support@stax-budget.com if you suspect someone else has accessed your account.
We will never ask for your password or recovery phrase. Do not send them to anyone.
Recovery limits
We do not hold a spare key to your budget. If you forget your password, you can use your recovery phrase. If you lose both, your encrypted budget cannot be decrypted, and we cannot restore it.
5. License and ownership
We grant you a personal, limited, revocable, non-exclusive, non-transferable license to install and use the app on devices you own or control. Stax Budget, including its software, design and trademarks, belongs to F1v3 Group LLC or its licensors. You may not copy, sell, modify, reverse engineer, or build a competing service from it, except where the law expressly allows.
6. Acceptable use
You may not use the Service to break the law or violate anyone’s rights; access another person’s account or budget without permission; interfere with, overload, or bypass the security of the Service; or resell the Service without our written permission. We may suspend or end access when reasonably needed to protect the Service, its users, or others.
7. Trials, subscriptions and billing
New accounts receive a free trial (currently 45 days) with every feature. After the trial, continued use of a signed-in account requires a paid subscription. Price, billing period, and renewal terms are shown before you buy and may vary by country.
Subscriptions are sold by Apple (App Store) or Google (Google Play) and renew automatically until you cancel. Cancel in the store you subscribed through before the renewal date. Deleting the app or your Stax Budget account does not cancel a subscription. Refunds follow the store’s rules and applicable law.
A family subscription covers the purchaser and a limited number of other accounts, as described at purchase. If the subscription ends, every account it covers loses paid access. We may change prices for future billing periods with the notice the law and the stores require.
When a trial or subscription ends, your encrypted data is not deleted because of that, but access through a signed-in account may be limited until you subscribe.
8. Changes and availability
We may update, change, or discontinue parts of the Service. We do not promise it will always be available, error-free, or compatible with every device. Keep your own records of anything you cannot afford to lose.
9. Ending your account
You may stop using the Service at any time and delete your account in the app under Settings › Account › Delete account or as described on the Delete account page. We may suspend or end your access if you materially breach these Terms or create security or legal risk; where practical, we will tell you first.
10. App stores
If you downloaded the app from Apple or Google, these Terms are between you and F1v3 Group LLC, not the store. F1v3 Group LLC, not the store, is responsible for the app. The store and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.
11. Disclaimers
TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, ACCURACY, OR THAT DATA WILL NEVER BE LOST. WE DO NOT WARRANT THAT CALCULATIONS, REPORTS OR OTHER OUTPUT WILL BE ERROR-FREE OR SUITABLE FOR YOUR FINANCIAL DECISIONS.
Some places do not allow these exclusions, so some may not apply to you.
12. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, F1v3 GROUP LLC WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES, INCLUDING MISSED OR LATE PAYMENTS, FEES, OVERDRAFTS, LOST PROFITS, OR LOST DATA. OUR TOTAL LIABILITY FOR ALL CLAIMS WILL NOT EXCEED THE GREATER OF THE AMOUNT YOU PAID FOR THE SERVICE IN THE 12 MONTHS BEFORE THE CLAIM, OR US $100.
These limits do not apply where the law does not allow them.
13. Indemnity
To the extent permitted by law, you will defend and indemnify F1v3 Group LLC against third-party claims arising from your unlawful use of the Service, Your Content, or your material breach of these Terms, except to the extent caused by our own breach or misconduct.
14. Disputes and governing law
Before filing a claim, each side agrees to describe the dispute in writing to the other and try in good faith to resolve it for 30 days. Send notices to support@stax-budget.com.
These Terms are governed by the laws of the State of California. Disputes not resolved informally will be brought in a state or federal court in California. If you are a consumer, this does not take away protections you have under the law where you live.
15. Changes to these Terms
We may update these Terms. We will post the new version here and update the date above, and give notice of material changes when required. If you do not agree to the updated Terms, stop using the Service and cancel any subscription.
16. General
These Terms and the Privacy Policy are the whole agreement about the Service. If a provision is unenforceable, the rest remains in effect. Not enforcing a provision is not a waiver. You may not transfer these Terms without our consent; we may transfer them as part of a merger, acquisition, or sale of assets.
